  1. MESSAGE PAD UNREGISTERED USER LICENCE AGREEMENT

  4. This is a legal agreement between you (an individual)
  5. and Io Development.  By using the Message Pad Unregistered
  6. v1.1 program, any of the data files associated with it,
  7. Setup files necessary for its installation, or any of its
  8. documentation files (all of which to be defined herein
  9. after as "SOFTWARE"), you are agreeing to be bound by the
  10. terms of this Agreement.

  12. This Licence Agreement is governed and bound by the
  13. laws of England and Wales.
  14.  
  15. In case of any part of this licence being held to be
  16. invalid or illegal, it shall be null and void to the
  17. extent of the illegality only.

  22.    WARRANTIES
  23.  
  24.    Io Development expressly disclaims any warranty for
  25.    the SOFTWARE.  The SOFTWARE is provided "as is"
  26.    without warranty of any kind, either expressed or
  27.    implied, including, without limitation to, any
  28.    implied warranties of merchantability or fitness for
  29.    a particular purpose.  The entire risk arising out
  30.    of use or performance of the SOFTWARE remains with
  31.    you.

  36. USE OF SOFTWARE

  38. By using the SOFTWARE, you are granting permission for
  39. data external to the SOFTWARE to be modified in order
  40. that the SOFTWARE will work correctly.

  43. NO LIABILITY FOR CONSEQUENTIAL DAMAGES
  44.  
  45. In no event shall Io Development or its suppliers be liable
  46. for any damages whatsoever.  Including, without
  47. limitation, damages for loss of business profit, business
  48. interruption, loss of business information, or any other
  49. financial loss) arising out of the use or inability to
  50. use any of the Setup SOFTWARE provided.  These terms apply
  51. even if Io Development has been advised of the possibility
  52. of such damages.

  55. EXCLUSIVE REMEDIES
  56.  
  57. Io Development's entire liability and your exclusive remedy
  58. shall not exceed the price paid to Io Development for the
  59. SOFTWARE.

  62. SOFTWARE LICENCE
  63.  
  64. 1. GRANT OF LICENCE.
  65. Io Development grants you (one designated individual), the
  66. right to use the Message Pad v1.1 Setup SOFTWARE and the
  67. data contained, in the manner provided below:
  68.  
  69. (A) An unregistered user licence permits you (one
  70. designated individual) to use the program on any computer
  71. system for accessing and using the SOFTWARE.
  72.  
  73. (B) You may make an unlimited number of copies of the SOFTWARE.
  74. You may only give unmodified complete copies of the original
  75. Setup SOFTWARE (the data that was originally included on the
  76. Message Pad Unregistered Setup/distribution media).  The
  77. Message Pad Unregistered program may not work correctly if it
  78. is not installed using the Setup SOFTWARE.
  79.  
  80. (C) In the case of a distribution to a third party, that
  81. individual must agree to the terms outlined in this Licence
  82. Agreement before they use the SOFTWARE.

  84. 2. The SOFTWARE, including any images and text incorporated
  85. in the SOFTWARE, is owned by Io Development and is protected
  86. by United Kingdom and European copyright laws and international
  87. treaty provisions.  You may not reproduce or distribute any
  88. part of the SOFTWARE or any written materials accompanying
  89. the SOFTWARE except as otherwise provided herein.

  91. 3. You may not rent or lease the SOFTWARE.
  92. Message Pad Unregistered v1.1 is Shareware.  This means that
  93. anyone can use the unregistered SOFTWARE without having to
  94. pay for its use.
